Establishing Paternity in Michigan: Understanding Your Rights & Responsibilities
Every family is unique, and it is not uncommon for children to be born outside of marriage. However, determining legal paternity is essential for both parents and children, as it establishes parental rights, responsibilities and ensures the child receives necessary support.
At Amy Byer Law, we help individuals in Troy, Warren, Livonia, and throughout Metro Detroit navigate paternity cases, ensuring that both mothers and fathers understand their legal rights and obligations when it comes to custody, child support, and parenting time.
What Is Paternity & Why Is It Important?
Paternity refers to the legal recognition of a man as a child’s father. In Michigan, when a child is born to married parents, the husband is automatically presumed to be the child’s legal father. However, when a child is born outside of marriage, paternity must be legally established before the father has parental rights.
Why Establishing Paternity Matters:
✔ Legal parental rights – A father cannot seek custody or parenting time without first being legally recognized.
✔ Child support obligations – Both parents are financially responsible for their child’s upbringing.
✔ Access to medical and family history – Establishing paternity ensures children can access important health records.
✔ Benefits for the child – Including inheritance rights, Social Security benefits, and health insurance coverage.
If paternity is not established, a biological father may have no legal claim to the child, and a mother may not be able to seek financial support from the father.
How to Establish Paternity in Michigan
1. Voluntary Acknowledgment of Paternity (AOP)
If both parents agree on who the biological father is, they can sign an Affidavit of Parentage (AOP) at the hospital after birth or later at the Michigan Department of Health and Human Services (MDHHS).
✅ This option does not require a court order but does establish the father as the legal parent.
✅ The father’s name is added to the birth certificate.
2. Court-ordered paternity Case
If there is a dispute over paternity, either parent or the state can file a paternity action in court. The court may:
✔ Order genetic (DNA) testing to determine biological paternity.
✔ Issue a legal determination of paternity.
✔ Establish custody, parenting time, and child support obligations.
Once paternity is legally established, the father can seek custody and visitation rights, and the mother can request child support.
Parental Rights & Responsibilities After Establishing Paternity
Once paternity is legally confirmed, the father has the right to:
✔ Seek custody or parenting time with the child.
✔ Be involved in important decisions regarding the child’s education, healthcare, and upbringing.
✔ Have his last name added to the birth certificate (if requested).
However, legal paternity also comes with responsibilities, including:
✔ Providing financial support for the child.
✔ Ensuring the child has healthcare and necessary resources.
✔ Participating in parenting time and co-parenting agreements.
Disputing Paternity in Michigan
If a man believes he is not the biological father of a child, he can:
✔ Request genetic testing before signing an Acknowledgment of Paternity.
✔ Challenge paternity in court if he believes he was mistakenly identified as the father.
✔ Seek legal assistance to disestablish paternity if a mistake was made.
It is critical not to sign an AOP unless both parents are absolutely certain about paternity, as rescinding an AOP is difficult and requires legal action.
Why Hire a Paternity Lawyer?
1. Protecting Parental Rights
Whether you are a father seeking custody or a mother needing child support, a paternity lawyer ensures that your rights and interests are legally protected.
2. Navigating Complex Legal Issues
Paternity cases can become complicated, especially if one parent disputes paternity. A lawyer handles legal filings, court proceedings, and DNA testing requests.
3. Establishing Fair Custody & Support Agreements
Once paternity is confirmed, an attorney can help establish custody, parenting time, and child support agreements that are fair and in the child’s best interests.
