Uncontested Divorce
Fully Settled Uncontested Divorce in Michigan
Flat-fee divorce services for spouses who have already agreed on all terms of their divorce.
Divorce does not always have to be stressful, expensive, or drawn out. When both spouses have already reached a complete agreement on every issue in their divorce, they may be able to proceed with an uncontested divorce.
At Amy Byer Law, we offer flat-fee uncontested divorce services for clients in Troy, Warren, Livonia, and the surrounding Metro Detroit area.
Important: This flat-fee service is designed for couples who are fully settled before the legal process begins. Amy’s role is to prepare the necessary divorce documents, handle filing and court requirements, and guide the case through the legal process. The flat-fee service does not include negotiating unresolved issues between spouses.
What Does “Fully Settled” Uncontested Divorce Mean?
An uncontested divorce means that you and your spouse have already agreed on all terms that apply to your divorce. There should be no remaining issues that require negotiation, mediation, or litigation.
This may include agreement on:
✔ Division of assets and debts
✔ Child custody and parenting time (if applicable)
✔ Child support and spousal support (if applicable)
✔ The marital home and other real estate
✔ Retirement accounts and other financial assets
✔ Any other issues that must be resolved before the divorce can be finalized
If you and your spouse still disagree about any of these issues, your divorce is not yet fully settled and the flat-fee uncontested divorce service may not be appropriate for your situation.
When everything has already been agreed upon, the legal process can often be handled more efficiently because there are no disputes requiring negotiation or litigation.
How Does a Flat-Fee Uncontested Divorce Work?
At Amy Byer Law, flat-fee pricing may be available for qualifying uncontested divorces. This allows you to know the legal fee upfront rather than being billed by the hour for the services included in the agreed scope of representation.
Flat-fee pricing does not mean that unresolved divorce issues will be negotiated for one fixed price. The flat-fee option is specifically intended for cases in which the spouses have already reached an agreement on all necessary terms.
Our Flat-Fee Uncontested Divorce Services May Include:
✔ Reviewing the terms you and your spouse have already agreed upon
✔ Preparing the required divorce documents and necessary court orders
✔ Filing legal paperwork with the court
✔ Handling procedural requirements throughout the case
✔ Guiding the case through the court process toward finalization
Negotiating disagreements between spouses is not included in the flat-fee uncontested divorce service. If unresolved issues arise, additional legal services may be necessary.
The flat-fee amount is determined on a case-by-case basis based on the circumstances and complexity of the divorce. During an initial consultation, Amy can review your situation, determine whether your divorce qualifies as fully settled and uncontested, and explain the applicable fee.
Benefits of a Fully Settled Uncontested Divorce
When spouses have already resolved all of their divorce terms, an uncontested, flat-fee divorce can offer several advantages.
1. Lower Cost Compared to a Contested Divorce
Because a fully settled uncontested divorce does not typically require extensive negotiations, contested hearings, or litigation over unresolved issues, legal costs can often be significantly lower than in a contested divorce.
2. A More Efficient Legal Process
When the major decisions have already been made, the case can move forward without spending time attempting to resolve disputes between the spouses. Michigan waiting periods and court requirements still apply, and the exact timeline will depend on the circumstances of the case.
3. Less Conflict and Emotional Strain
Since both spouses have already agreed on the terms of the divorce, the legal process can often be smoother, less adversarial, and less stressful than a contested case.
Is a Fully Settled Uncontested Divorce Right for You?
An uncontested divorce may be appropriate if you and your spouse:
✔ Have already agreed on every term of the divorce
✔ Have no remaining disputes involving property, finances, custody, parenting time, support, or other divorce issues
✔ Do not need Amy to negotiate terms between you and your spouse
✔ Want an efficient, cost-effective way to complete the legal divorce process
✔ Prefer the predictability of a flat-fee option when available
If you are still trying to reach an agreement with your spouse, this particular flat-fee service is not designed to handle those negotiations. Amy can discuss your situation with you and help determine what type of divorce representation may be appropriate.
If you and your spouse have already reached a complete agreement and are considering an uncontested divorce in Metro Detroit, including Troy, Warren, or Livonia, Amy Byer Law can help you complete the legal process.
